ORDINANCE NO. 555
AN ORDINANCE REGARDING THE SALE OF PROPERTY

THE CITY OF STAPLES DOES ORDAIN AS FOLLOWS: 

Sec. I The City of Staples is hereby empowered to sell the following real estate located in the City of Staples, County of Todd, State of Minnesota:
Lot A Auditor's Subdivision of Lot 54 of the SW 1/4 NW 1/4 Lot, Section 12, Township 133, Range 33, reserving the following easements to the Grantor:

1) An easement for public roadway purposes over and across the following described property, which said easement shall run with the land and be for the benefit of the general public: Commencing at the northwest comer of Lot A, Auditor's Subdivision of Subdivision of Lot 54 of the SW ¼ of NW ¼ of Section 12, Township 133, Range 33; thence South along the West line of said Lot A to the southwest comer of Lot A; thence East along the South line of Lot A a distance of 33 feet; thence North and parallel with the West line of Lot A to the North line of Lot A; thence West along the North line of Lot A a distance of 33 feet to the point of beginning;

2) A 30 foot wide easement for the purpose locating, establishing, maintaining, and constructing over and across the following described land a certain drainage ditch together with such rights of entry upon, passage over, deposit of excavated earth and storage of material and equipment on such area as may be necessary or useful for the construction, maintenance, cleaning and repair of such drainage ditch and grantors release the City of Staples from any and all claims or damages arising in any way or incident to the construction or maintenance of the drainage ditch across the following described land: Commencing at the northwest comer of Lot A, Auditor's Subdivision of the Subdivision of Lot 54 of the SW¼ of NW¼ of Section 12, Township 133, Range 33; thence South along the West line of said Lot A a distance of 30 feet; thence East and parallel with the North line of said Lot A to the East line of Lot A; thence North along the East line of Lot A distance of 30 feet to the northeast comer of Lot A, and thence West along the North line of Lot A to the point of beginning.

Sec. 2 The net proceeds from the sale shall be used pursuant to Section 11.05 of the Staples City Charter.

Sec. 3 The Mayor and City Administrator are authorized to execute any documents to complete the sale.

Sec. 4 This ordinance shall take effect from and after its passage and publication in accordance with law.
